Terms of Service

These Terms govern the Possessions service supplied by LIGHT AND DARK ENERGY LTD, company number 15095270, registered at 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom (“we”, “us”). Contact: contact@lightanddarkenergy.uk.

1. Agreement, eligibility and availability

By activating a vault or purchasing a membership, you agree to these Terms, the Privacy Policy, Subscription Policy and Acceptable Use Policy. You must be at least 18 and capable of entering a contract. Paid memberships are offered only in supported countries outside the EU/EEA. Customers with an EU/EEA billing address are not eligible to purchase. Stripe may restrict a transaction for sanctions, regulatory, fraud or other compliance reasons. The fictional public demo may be viewed internationally.

2. The service

Possessions organises user-entered information about assets, obligations, cash flow, occupancy and private notes. Features may evolve. We will not materially reduce a paid service without reasonable notice where practicable.

3. Not professional advice

Values, totals, reminders and forecasts are informational tools. They are not valuations, accounting, tax, investment, insurance, legal, security or property-management advice. You remain responsible for decisions, filings, payments, compliance and professional advice.

4. Access and recovery

You are responsible for the Quantum ID, Master Secret, Recovery Key and devices. We cannot recover protected content without a valid recovery credential. We are not liable for loss caused solely by your loss or disclosure of credentials, except where liability cannot lawfully be excluded.

5. Sensitive information

The service is not a regulated custodian, bank vault, emergency system or password manager. You decide whether to store safe combinations or similarly critical information and accept the residual risks described in the Security Notice.

6. Your content and data-protection roles

You retain ownership of your content and grant us a limited licence to host, process, back up and transmit it only to provide, secure and comply with law for the service. You must have the right to enter the content and must not use the service unlawfully. We act as controller for account, security, billing and service-operation data. If you use Possessions in a business or professional capacity and enter personal data about tenants, family members, staff, contractors or other people, you are the controller for that customer content and we process it on your behalf under the Data Processing Addendum. The household exemption may apply to an individual’s purely personal or household use, but it does not change our responsibilities for service data.

7. Third-party services

For paid memberships, Stripe’s Link service acts as merchant of record and handles the sale, payment, applicable transactional taxes, fraud, disputes and transaction support; its checkout terms and receipt identify the seller for that transaction. These Possessions terms continue to govern use of the service. OpenStreetMap/Leaflet provide mapping components; Airbnb calendar feeds are imported at your instruction. Their services and terms are separate. We are not affiliated with Airbnb.

8. Availability and changes

We aim for reliable access but do not guarantee uninterrupted or error-free operation. Maintenance, security incidents and external services may affect availability.

9. Charges, cancellation and refunds

Memberships renew until cancelled. Prices, billing periods, cancellation rights and refunds are set out in the Subscription Policy displayed before checkout. The public demo is free; private data entry requires a paid membership.

10. Suspension and termination

We may suspend access reasonably necessary for security, non-payment, legal compliance or material breach. You may cancel billing and delete the vault. Deletion is irreversible.

11. Liability

Nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded. Subject to that, we are not responsible for indirect or consequential loss, lost profit, lost opportunity, inaccurate user-entered data, missed reminders or credential loss. For paid services, our aggregate contractual liability is limited to fees paid in the 12 months before the event, where lawful. Consumer statutory rights remain unaffected.

12. Law and disputes

These Terms are governed by the laws of England and Wales. Consumers retain mandatory rights and may bring claims in courts available under applicable consumer law. Contact us first so we can try to resolve a complaint.

13. Changes

We may update these Terms for legal, security or service reasons. Material changes will be presented in the service and require renewed acceptance where appropriate.
